The length of time needed to complete the probate of an estate depends on the size and complexity of the estate and schedule of the probate court. Generally, there are two types of probate:
- Summary administration - If the estate is less than $75,000 and there is a will, there is little court involvement - the judge makes a distribution plan and the assets are distributed according to the will in a few months' time.
- Formal administration - Is for estates that have no will or are in excess of $75,000. In these situations, the court will appoint a personal representative to handle the distribution. This takes approximately 6 months.
